ATTENTION ALL INSURANCE VIOLATIONS

All violations of ARS 28-4135 A, B, or C will have a new mitigation requirement.

If a violator provides proof that insurance was valid on the date of violation, the charge will be dismissed.

If the violator did not have insurance on the date of violation but has been able to obtain
BOTH:

  • 6 month Insurance Policy for the vehicle listed on the citation; and
  • 36-month driving record from MVD showing no previous violations of 28-4135 within the last 24 months or one violation within the last 36 months.

by the arraignment date, the court MAY waive or reduce the penalty. This means the court has the ability to waive the fine and the accompanying driver license suspension of the driver and license and registration suspension of the vehicle through MVD.

If the defendant does not provide A & B at the arraignment date, then judgment may be entered. Continuances to obtain A & B will ONLY be granted for good cause.
