What Is a Conditional Use Permit?

A Conditional Use Permit allows certain uses that are conditionally permitted within a zoning district to be reviewed on a case-by-case basis. The Planning & Zoning Commission may approve a CUP subject to conditions designed to ensure compatibility with surrounding properties.

Step-by-Step CUP Process (Summary)

  1. Schedule a required pre-application meeting with Planning staff. Applicants should bring a project narrative and a conceptual site plan.
  2. Complete any required public pre-notification, such as pre-scoping letters or a neighborhood meeting, prior to submitting the CUP application. More information about the Citizen Review Process.
  3. Submit a complete Conditional Use Permit application package and applicable fees.
  4. City staff reviews the application for completeness and code compliance and schedules the item for a Planning & Zoning Commission public hearing.
  5. Public notice is provided, including newspaper publication, mailed notices, and on-site sign posting by the applicant.
  6. The Planning & Zoning Commission conducts a public hearing and approves, approves with conditions, or denies the request.
  7. If appealed, the City Council considers the appeal and may affirm, modify, or reverse the Commission’s decision.

Perfected appeals are scheduled for City Council consideration at the next available meeting occurring no later than 45 days from receipt of the perfected appeal.
